[SC] cpc O. 39 R. 1 , CPC S. 115 – Application under Order 39 Rule 1 dismissed by the holding that the relief asked for could not be granted at this stage as it would amount to decreeing the Suit itself – Appeal before the Additional District Judge also dismissed – High Court set aside the concurrent findings of fact and allowed the revision petition – Under the Proviso added by the 1999 amendment to the CPC to Section 115, revision petitions filed under section 115 CPC are not maintainable against interlocutory orders – judgment of high Court set aside and judgment of the Courts below restored.
