CPC – S. 25 – Transfer of case – Age of wife is relevant factor to transfer matrimonial proceedings at her instance.
After going through the materials on record and after considering the age of the wife/petitioner, the court is of the view that the aforesaid case being civil proceeding no. 549 pending before the learned Judge, Family Court at Cuttack, Orissa be transferred to the Family Court at Jaipur in the State of Rajasthan. Accordingly, the Court allow the application for transfer and direct transfer of the aforesaid case to the Family Court at Jaipur, Rajasthan.
