Transfer of Property Act, 1882, Section 58(c) – Conditional Sale – mortgage – Registered sale deed was executed on 10.12.1968 and on the same date, a separate agreement was executed whereby the plaintiff has agreed to repay the amount and secure reconveyance of the property – Since the two separate documents were executed, this Court has rightly found that it is not a document of mortgage but of conditional sale which is not covered by the proviso to Section 58(c) of the Act.
