Specific Relief Act 1963, S. 20 – Remedy for specific performance is an equitable remedy and Section 20 of the Specific Relief Act confers a discretion on the Court – In the context of the discretion under Section 20 of the Specific Relief Act, this Court has considered whether it is appropriate to direct specific performance of a contract relating to the transfer of immovable property, especially given the efflux of time and the escalation of prices of property – Sale deed must be executed for the current market price of the suit property – Court may impose a reasonable condition in the decree such as payment of an additional amount by the purchaser.
