East Punjab Urban Rent Restriction Act, 1949, (III of 1949) Section 13(f) – Legislature in its wisdom, has used the expression “occupying” which has to be distinguished from the expression “ownership” – In the instant case, the landlord in his petition has categorically mentioned that he is not occupying any other building, rather he has gone even a step ahead and disclosed that none of his family members are occupying any other building in the urban area concerned – Hence, non-disclosure of the ownership of the landlord's son to the extent of 50% share in a residential house would be of no material consequence; more so, when the demised premises has not even been asked for by the landlord for the requirement of his son.
