CPC O. 9 R. 13 - Lack of knowledge

CrPC S. 41-A, S. 438 - After issuance of notice under Section 41-A Cr.P.C., if the police feels that the accused has to be arrested, without obtaining the permission from the Magistrate concerned, they cannot arrest the accused.

CPC O. 9, R. 13 – As a consequence of setting aside of the ex parte decree , Defendants cannot be permitted to file their written statement.
