Based on the above discussion and examination, we are of the view that first of all the Respondent auction purchaser was not a consumer under consumer protection act, 1986 and the consumer complaint was not maintainable on this ground alone. Moreover, it was highly time barred also. We are convinced that the possession of the auctioned property could not be handed over to the respondent on account of various litigation cases.
