Prisons Act, 1894 (9 of 1894), Section 31 – Punjab Jail Manual, paragraph 713 – An un-convicted criminal prisoner has the right to maintain himself from private sources, however, subject to rules approved by the Inspector General – Petitioner is a convict and not an undertrial and thus, he does not have the right provided by paragraph 713 – Those who have still not been convicted, only are entitled to claim this right – The right is not absolute – Rules referred to in this provision can only mean administrative instructions to be issued from time to time – Petitioners having been classified as dangerous/notorious/hardened criminals having the tendency to smuggle in prohibited articles through cooking utensils and material, have been denied this facility – The same is a reasonable restriction and thus, denial of the facility, even to undertrials, is justified.
