Abuse of the process of the court - An abuse of the process of the court may be committed by the court or by a party - Where a court employed a procedure in doing something which it never intended to do and there is an abuse of the process of the court it can be corrected.

CPC S. 100 - Concurrent findings of facts recorded by both the Courts below - Unless the concurrent findings recorded by the courts below were found to be perverse, the same were not required to be interfered with by the High Court in exercise of powers under Section 100 of CPC.
