Criminal Procedure Code, 1973, Section 374(2) – Whether an appeal against conviction can be dismissed on the grounds that the accused is evading justice  – Despite the remedy of an appeal being a valuable right , the High Court ruled that the appellant abandoned his right to prefer an appeal the minute he escaped from detention and flagrantly violated the legal system –  However, there is no justification to dismiss an appeal against conviction that was already admitted for final hearing for non-prosecution without addressing the merits due to the appellant's action of evading justice. – Remanded
