CPC, 1908 Order 8, Rule 6-A, Section 11, Explanation V – Explanation V below Section 11 of the CPC provides that any relief claimed in the plaint, which is not expressly granted by the decree, shall for the purposes of this Section, be deemed to have been refused – Order VIII Rule 6A of CPC provides that a counter claim shall have the same effect as a cross suit, so as to enable the Court to pronounce a judgment in the same suit, both on the original claim and on the counter claim – It also provides that the counter claim shall be treated as a plaint and be governed by the rules appli-
cable to plaints.
