Medical Council of India Regulations, 2000 – Reg.9 – Reservation of 50% Super Specialty seats (DM/M.Ch.) for in-service candidates in Government Medical Colleges in the State of Tamil Nadu – Court vide interim order dated 27th November, 2020, passed in Civil Appeal No. 3840 of 2020 [Dr. Prerit Sharma V. Dr. Bilu B.S.] had directed that the counselling for admission to Super Specialty Medical Courses for the academic year 2020-2021 shall proceed without providing for reservations to inservice doctors – Taking into consideration the principles of judicial discipline and judicial propriety, we should be guided by the judgment of the Constitution Bench in the case of Tamil Nadu Medical Officers Association (supra) rather than the judgment of the Constitution Bench in the case of Dr. Preeti Srivastava (supra) – We are, therefore, of the view that no case is made out for continuing the interim protection which was granted for the academic year 2020-2021 vide interim order dated 27th November, 2020 (supra) and thus, we reject the prayer in that regard.
