As per Mulla's Hindu Law it has been laid down that the property of Math is held by Mahant as spiritual head of the institution and is held in trust for the purposes of the institution wherein surplus income is added to the endowment and not applied for personal enjoyment of the head of the Math. The very functions and duties of Mahant are regulated by custom and therefore as a general rule of Hindu law, the property given for the maintenance of religious worship and all charities connected with it, are inalienable.
