CPC O. 23 R. 3A – Bar under Order XXIII Rule 3A applies only to parties who were part of the compromise, leaving non-parties free to sue if their independent rights are affected. A compromise binds only those who participated, and does not extend to strangers—particularly where a beneficiary holds a probated Will conferring title in rem.
